Honestly I can't even process shit like this because it makes me so fucking angry. I had a friend deliberately killed by a politician a few years back (who of course faced no penalty) and sometimes you just can't let this shit into your head or you'll start putting pipe bombs in mail boxes.

I got screenshots of the article (though I doubt it will be taken down unless some sort of police contact is made), and I called the police info line. They said the best thing to do is to go into the station to file a report and make a complaint, but that without the victim coming forward, there might not be much they can do. I suppose it's possible the cyclist did report her and already filed a complaint, in which case, the article would hopefully get linked up with the pre-existing complaint. I'm worried the cops won't take me reporting this very seriously, though.

lets say a cyclist is stopped at a 4 intersection. He is a little beyond the white line (a few feet), on the left side (near center of the road)

a car enters the intersection from his direct right, and runs him over as he makes a left turn.

Driver stopped, gave insurance. Insurance company is hinting they might dispute the claim because he was 'over the line' (does not help that our cyclist has a big claim. Lets say a carbon racebike with red + powermeter + good wheels etc)

should friend just lawyer up?

In other words, the driver entering the intersection from his right was making a left turn. Cut the apex of the turn, and hit my friend, who might have been 5 feet past the white line.

yeah i figured out what you meant. To me it seems like both parties hold some responsibility for the collision, not equally but still. It may be enough for the ins company to worm their way out of it.

Yeah. Playing dumb might be his best bet, for now. (getting him in touch with the local advo groups to find a cycle friendly lawyer). Poor dude got smanged on his CAAD10 2 months ago.

It just sucks because I push into the intersection all the time, especially if you're in a situation where there is very little visibility.

Looking at the intersection on a map, there is really no way the car would not have entered the turn lane- if you are on that arc.

Always call a lawyer and explain it to them. Preferably one who won't make you pay unless you win. Those lawyers won't take a case they can't win, so they won't try to convince you to take it to court (and thus pay them to lose).

Anyway, call a lawyer and explain it to them and they'll be able to tell you whether you can do anything about it. Cyclists are always on the losing end in America and you should take any advantage you can when fighting this kind of shit.

it's developed a bit more. All the lawyers my friend has contacted have become uninterested as soon as they found out there was no bodily harm. Even the ones recommended by cyclist advo groups!

Unfortunately maryland has some weird negligence statue, if he was in front of the line he shares responsibility for the accident. It's some bullshit, but i guess he and his bike ended up on the ground in front of the line.. so thats how the insurance company is claiming dual responsibility

friend has stated he cant remember were he was (partial truth, i guess). He is hoping that he can just claim his frame and front wheel - some 1700 bucks instead of an itemized 6k bike... that might be low enough for the insurance company to just pay out, as he has told them he has found legal council..

the apportioning of damages according to causal culpability isn't unique to mland - if you're bringing up a negligence claim the second thing the defendant's gonna bring up is contributory negligence (first being any attempts to shoot it down entirely). anything to limit their client's/ client's insurance fund's culpability

lawyers aren't gonna be interested in your friend's case because there's no personal injury... so no chance at megabucks, or even moderatebucks

best case scenario anyway is settlement out of court. keep in mind though, if he's only looking for 1.7k worth of damages... few billable hours and court costs will likely exceed that. not a fantastic position to be in :/

A friend of mine got hit today on his way back to campus after a training ride. I heard everything second-hand so I don't know the details of the accident but the driver got out of the car and beat my friend up while he was on the ground before driving off.

I can't believe something like that would happen around here. Pretty pissed off with humanity right now.
